Epic's lawsuit against Fortnite cheaters just got more complicated

The defendant in question turned out to be a 14-year-old, who the video game makers can not legally sue. "Under these circumstances, the law requires that we file suit or drop the claim".

Cheating in an online game can ruin the experience for everyone, so game publishers react quickly and hit the ban button regularly for players attempting to gain an unfair advantage. Epic is suing both of them for "infringing Epic's copyrights by injecting unauthorised computer code into the copyright protected code". Epic is in complete violation of this as well as other individual websites and news reporting agencies". The mom digs her heels in hard, pointing out that the EULA, which Epic makes heavy mention of in its complaint alleging that the cheaters modified the game's code, requires that minors get permission from a parent of legal guardian in order to play Fortnight. Epic Games has left the young teenager on the lawsuit because he uploaded a video to YouTube revealing how to use cheats in Fortnite. One of them is that it is against DE law to publish names on minors, and that he is unlikely to be the developer/distributor of the cheating tools because of his age. In fact, the boy even made a second YouTube video in which he admitted to using the software, live streaming himself cheating, and refusing to take the initial video down. Contract law generally prohibits entering into a business agreement with a minor, which would more or less make Epic's claims null and void. You want to take it to cheaters, but the reality is, a large portion of them are just kids who don't understand what they're potentially getting themselves into. Not only were the pair accused of using paid "aimbot" software, but they also allegedly offered support for the service and helped stream snipe popular Twitch broadcasters, a practice that has recently seen a lot of PUBG players banned. But these hacks do have a harmful effect on an online game community by undermining the integrity of a title's fair and level playing field.

This case is but one of the two Fortnite lawsuits that began last month.

Federal Judge Says US Military Must Accept Transgender Troops In New Year
Kollar-Kotelly's memo comes less than a week after a second U.S. court blocked the ban for violating both the U.S. Constitution's equal protection clause and the guaranteed rights of service members to recieve medical care.

Epic said that the video is the big issue, as once the company had the video taken down via DMCA claim, the boy then filed a counterclaim.

She emphasises that given that the game is free-to-play, there was no question of loss of revenue for the company. Cheating may be something developers have a legitimate interest in stamping out, but doing so by using their formidable resources to crush a 14-year-old would appear to be a step too far.
