Virginia election board postpones draw to decide tied delegate race

The balance of the Virginia House of Delegates is slated to be decided by a random drawing on December 27, but democrats are filing motions to try and stop that from happening.

The ballot, a copy of which was obtained by our partners at The Virginian-Pilot, shows both candidates' names are bubbled in for the 94th District race, but Simonds' name has a slash over it.

Now it's 51-49 in favor of Republicans. David Yancey were scheduled to put their names into a bowl.

Simonds filed a challenge with the Virginia Board of Elections over a vote that was counted for her opponent, GOP incumbent Del.

A three-judge panel ruled last week that the ballot would be counted, bringing the race to a tie.

The State Board of Elections originally planned to meet Wednesday morning to draw lots and break the tie. Simonds stands by results from Tuesday's recount (which had her winning by one vote).

Democratic candidate Shelly Simonds and Republican Del. My team followed the rules of the recount process, and the other side really didn't.

Simonds isn't arguing that the intent of the voter who casted the contested ballot was unclear.

Yancey's attorneys argued that the ballot was clearly a vote for Yancey. The first name pulled out of the bowl would be declared the victor. She's saying instead that it was too late to raise a challenge when Yancey's lawyers spoke up. But a day later, and after a whirlwind toufr of TV interviews, her Cinderella story found its pumpkin. "That was a violation of Virginia law and it was a violation of the court order, and it was contrary to State Board of Elections guidance".

But either way, the Democrats posted historic gains this year in the wake of Republican Donald Trump's stunning White House victory in 2016.
