Tom Petty's Publisher Sues Spotify for a Measly $1.6 Billion

The lawsuit, filed on December 29 in California federal court, alleges Spotify is using music by Tom Petty, Rage Against the Machine, The Doors, Steely Dan and many other artists without license or compensation.

While Spotify has yet to comment on the lawsuit, it previously responded to Wixen's settlement objection by questioning its authority to represent its clients in matters of litigation.

While Spotify has worked to track down the rights to the sound recordings of the songs it streams, it has never adequately secured the equivalent rights for the songs themselves as published works, according to the suit. While the songwriters have administrative agreements that allow Wixen to negotiate licensing deals, Spotify notes that those agreements say nothing about litigation. Wixen is far from the first publisher or artist to sue them over improper compensation.

Garner became an activist and spoke out against police brutality after her father's death was caught on cell phone video in 2014. In a series of tweets after the meeting, Erica Garner again stressed that she wanted to see progress on the investigation.

"As a direct and proximate result of Spotify's willful and infringing conduct, Wixen is entitled to actual damages, including the substantial profits of Spotify", the suit reads.

The lawsuit comes after the Sweden-based music-streaming service agreed in May to pay more than $43 million to settle a proposed class-action lawsuit brought against it by songwriters who accused the company of not licensing or paying them for use of their music. As Spotify has publicly admitted, and as recent lawsuits and settlements confirm, Spotify has repeatedly failed to obtain necessary statutory, or 'mechanical, ' licenses to reproduce and/or distribute musical compositions on its service.
