Stormy Daniels Sues Trump, Claiming He Never Signed 'Hush Agreement'

Avenatti told NBC News on Wednesday that Cohen also obtained a secret restraining order through the private arbitration proceeding and barring her from publicly discussing her allegations against Trump.

According to the lawsuit, Clifford was inspired to step forward with her account of at least one tryst with Trump at the Beverly Hills Hotel shortly after the Access Hollywood tape was released. As part of the agreement, Trump's personal lawyer, Michael Cohen, has said he paid Clifford $130,000 just 12 days before the 2016 presidential election.

Her lawyer Michael Avenatti appeared on the Today Show on Wednesday after he filed a lawsuit against the president on Daniels' behalf that seeks to release her from the agreement she signed to keep quiet.

The lawsuit claims Trump intentionally refused to sign it so that he would have deniability in case the agreement ever came to light. "I$3 t strains credulity to conclude that Mr. Cohen is acting on his own accord and without the express approval and knowledge of his client Mr. Trump".

Guthrie also directly asked Avenatti if Trump had sex with Daniels, which the lawyer simply replied, "yes".

If Trump was aware of the agreement, and it was made primarily to aid his campaign, the failure to report the payment as an in-kind donation would potentially violate campaign finance laws.

The nondisclosure agreement used the aliases David Dennison and DD to refer to Trump, and Peggy Peterson and PP to refer to Daniels.

According to the Wall Street Journal, that payment was made in October 2016, the same month as the nondisclosure agreement.

Cohen has said he paid Clifford $130,000 of his own money in 2016, the year Trump was elected president, but said neither the Trump Organization nor Trump's campaign was a party to the transaction, though he declined to say publicly what it was for. In return, Clifford was not to disclose any confidential information about Trump.
