Lindsay Lohan loses 'Grand Theft Auto' appeal

The lawsuit Lohan filed involved a parody character in GTA V that goes by the name Lacey Jonas, who is briefly featured in one mission that naturally involves the paparazzi.

In its motion to dismiss, the software company also alleged in their defense that the 31-year-old star has a "history of misusing the legal system".

In addition to shooting down her lawsuit, the Court of Appeals also ordered Lohan to pay Rockstar's court costs. Lohan said that the game's widely distributed promotional, box and disc art (one sample is above) was such a portrait, used without her written consent.

Lindsay Lohan versus Grand Theft Auto 5 was still a thing, apparently.

The Court of Appeals' decision centers on whether Lacey Jonas constitutes a "portrait" of Lohan under NY state law.

Ghostly galaxy without dark matter stuns astronomers
Therefore, researchers were surprised when they uncovered a galaxy that is missing most, if not all, of its dark matter. His stars are enough to explain his whole mass, and there seems to be no extra space for dark matter, "he added".

When analyzing what constitutes a "portrait" under NY state law, Associate Judge Eugene Fahey discusses how digital technology evolves and that laws must be interpreted with an eye toward encouraging invention.

Lohan's lawyer Frank A. Delle Donne did not immediately respond to a request for comment.

She lost the original case in 2016, and appealed - but the courts have now ruled against her once and for all. "Here, the Jonas character simply is not recognizable as plaintiff inasmuch as it merely is a generic artistic depiction of a "twenty something" woman without any particular identifying physical characteristics", the court's opinion states.

"[The] artistic renderings are indistinct, satirical representations of the style, look and persona of a modern, beach-going young woman. that is not recognisable as plaintiff", Judge Eugene Fahey wrote in his ruling. In preparation for this appeal, numerous media organizations asked the court to reject the case in order to protect the First Amendment and artists' rights to create parodies or works loosely based on real people, according to Rolling Stone.
