Walker on March 28 reversed course and said he would not ask the Wisconsin Supreme Court to delay a court order that he call special elections to fill the legislative vacancies.

State law requires Walker to order special elections to fill vacancies that occur before May of an election year. The court denied the request Wednesday afternoon, writing that electing representatives is never a waste of tax dollars and Walker is obligated to order special elections.

Reilly issued his ruling hours after the Department of Justice appealed two Dane County judges' decisions on the case. A Dane County judge last week ordered him to do so by noon today. "Walker's refusal to do his job", Holder said in a statement after the appeals court ruling on Wednesday.

Walker has been admonished by two state circuit court judges for dragging his feet and, in their view, violating a state law that requires Wisconsin governors to call special elections for vacancies "as promptly as possible".

Even if Democrats won both seats, Republicans would maintain a firm grip on power in Madison, where the GOP controls 18 of 33 state Senate seats and 63 of 99 state Assembly seats. Instead, Walker, Attorney General Brad Schimel and the Republican legislators are going to waste taxpayers' money by legal challenges and calling yet another special session.

The commission doesn't have an estimate for how much a separate special election in January cost. Walker then dropped his appeal and scheduled the elections for June.

"Those voters are going to be deprived of their voice to be heard in a redistricting special session and I think that's absolutely important", Kessler says.

Senate Majority Leader Scott Fitzgerald says the senate is moving ahead with the public hearing for a change in the law tomorrow. The Senate seat covers the Door County peninsula northeast of Green Bay and the Assembly seat is in a mostly rural area north of Madison.

It's unclear what steps the Senate will take now that Walker has said he will call the special elections. They moved to change the special election law - and make it retroactive.

Walker went back to court to ask for more time to postpone holding the elections, but two different courts ruled he was constitutionally required to schedule them.

This is not a Republican or Democratic issue.

Fitzgerald cited the special election to replace Republican state Sen.

Fitzgerald argued that there would be potential confusion because the special election would overlap with the start of the fall election cycle with nomination papers circulating at the same time.
